Highlights: H-2B visa quota finalized for F.Y. 2024!

  • The USCIS (U.S. Citizenship and Immigration Services) received sufficient petitions to set the cap for H-2B visas.
  • 20,716 additional H-2B visas will be granted for returning workers in the first half of F.Y. 2024.
  • The petitions for the H-2B non-immigrant workers will be made available on or before March 31, 2024.  
  • The visas will be issued via the H-2B supplemental cap (F.Y. 2024 TFR).

H-2B Visa Cap Set for Returning Workers

The USCIS received sufficient petitions for the H-2B visa cap. 20,716 additional visas will be granted to Returning Workers. The final date for collecting and allocating the petitions was January 9, 2024.

The petitions for the H-2B non-immigrant workers will begin on or before March 31, 2024, with an allocation of 20,000 visas via the H-2B supplemental cap temporary final rule (F.Y. 2024 TFR).

US Temporary Final Rule (TFR)

The F.Y. 2024 TFR was first introduced on November 17, 2023, with the USCIS accepting petitions for the H-2B visas. The workers who could not get through the 20,716 cap can re-apply for the 20,000 cap. Petitions for 4,500 workers were raised as of January 12, 2024.

 

The start dates for the petitions are set on or before March 31, 2024, for returning workers, with a cap of 20,716 and 20,000 for non-immigrant workers.
