Foreign nationals can now work in Denmark without a "work permit"

The authorities of Denmark announced that specific categories of foreigners can work in Denmark for shorter durations without a work or residence permit. The new rules were implemented starting from 17 November 2023.

 

Foreign nationals can work in a Denmark-based company for two different work periods within six months, each with 15 working days. Individuals must stay outside the country for at least 14 days between each working period.

 

 

Eligibility for the new Denmark work rules

Candidates need to fulfill the eligibility requirements mentioned below to qualify for the new work regulations of Denmark:

  • Candidates must be employed with a foreign company affiliated with a Denmark-established company.
  • The Danish company to which a foreign worker chooses to apply should have at least 50 employees.
  • Foreign nationals from managerial and high/intermediate knowledge-level jobs are eligible for the new revisions.

Categories that are exempted from Denmark work permit

Certain other candidates from non-EU/EEA areas may be exempted from the mandatory work permit requirements.

The categories that are exempted from work permits are as follows:

 

Guest teachers for up to 5 days:

Teachers who will be undertaking teaching for up to 5 days under the Ministry of Culture institutions or Ministry of Higher Education and Science within 180 days do not require a permit.

 

General exemptions:

Foreign diplomats, including their family and household staff, and staff on commercial ships, international trains, and vehicles with specific shipyard and court visit limits.

 

Board members up to 40 days:

Board members need not require a permit for up to 40 days within a year, provided they are assigned professional duties in Denmark.

 

Artists, musicians and performers:

Artists, performers, musicians, and their staff are exempted if they play a crucial role in public events that last for less than 14 days. Dressers, makeup artists, managers, light and sound staff, and tour drivers may also be exempted.

 

Experts with dedicated work assignments for up to 90 days:

Household staff of foreign nationals, professionals, researchers, foreign company representatives, etc., visiting Demark for up to 90 days need not require a permit.
